Terms & Conditions

These Terms & Conditions (Terms) govern your access to and use of the Fellowship Ready website, applications and related services (the Service), operated by Fazel Rostamzadeh Bakhtiyari (ABN 37 503 342 642) of Gold Coast, Queensland, Australia (we, us or our). By creating an account, or by accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

1. Eligibility

You must be at least 18 years old and capable of entering into a legally binding agreement to use the Service. The Service is intended for medical practitioners, psychiatry trainees and others preparing for or interested in psychiatry examinations. You are responsible for ensuring your use of the Service is permitted in your jurisdiction.

2. The Service

The Service is an online study and exam-preparation aid. It provides practice questions, practice cases, automated feedback, mock examinations and related learning tools. The Service is provided for personal study purposes only. We may add, change, suspend or remove features of the Service at any time.

3. No guarantee of results

We do not guarantee, promise or warrant any particular outcome from your use of the Service. In particular, we do not guarantee that you will pass any examination, achieve any mark or grade, gain any qualification, or obtain any professional advancement. Examination success depends on many factors outside our control, including your own preparation, ability and performance. Any statements about typical results, sample questions or study outcomes are illustrative only and are not a promise of results for you.

4. Educational purpose only — not professional advice

The Service and all content within it are provided for general educational and exam-preparation purposes only. They do not constitute medical, clinical, legal, financial or other professional advice, and must not be relied upon as such. Nothing in the Service is a substitute for your own professional judgement, formal training, clinical supervision, or the official curricula, materials and requirements of the relevant examining or accrediting body. You must not use content from the Service to diagnose, treat or manage any actual patient. You remain solely responsible for your own clinical decisions and professional conduct.

5. No affiliation with examining bodies

The Service is independent. It is not affiliated with, endorsed by, sponsored by, or approved by the Royal Australian and New Zealand College of Psychiatrists (RANZCP) or any other examining, accrediting or professional body. All third-party names, trademarks and examination names are the property of their respective owners and are referred to only for identification and descriptive purposes.

6. Automated and AI-generated content

Parts of the Service — including question and case extraction, marking, feedback, explanations and classifications — are produced by automated systems, including artificial intelligence. Such content may contain errors, omissions or inaccuracies, and may not reflect current best practice or the standards of any examining body. Automated marking and feedback are estimates only and do not predict or represent how any real examiner would assess your work. You should independently verify all content against authoritative sources before relying on it.

7. Accounts and security

You must provide accurate information when creating an account and keep it up to date. Your account is personal to you and must not be shared, sold, transferred or used by anyone else. You are responsible for keeping your login credentials confidential and for all activity under your account. We may limit the number of devices or concurrent sessions per account, and may suspend or terminate accounts we reasonably believe are being shared or misused. You must notify us promptly of any unauthorised use of your account.

8. Fees, subscriptions and billing

Access to paid features requires a subscription or payment of the applicable fees, shown in Australian dollars (AUD) and inclusive of GST where applicable. Payments are processed by our third-party payment provider; we do not store your full card details. Subscriptions renew automatically for successive periods at the then-current price until cancelled. You may cancel at any time, effective at the end of the current billing period; unless required by law, fees already paid are not refunded on cancellation. We may change our fees on reasonable notice; changes take effect at your next renewal.

9. Refunds and the Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under that law where it cannot lawfully be excluded. Outside of those non-excludable rights, fees are non-refundable except where we choose to provide a refund at our discretion or are required to by law.

10. Acceptable use

You must not: use the Service for any unlawful purpose; copy, reproduce, scrape, republish, distribute, sell or commercially exploit any part of the Service or its content; share your account or circumvent access controls; attempt to gain unauthorised access to the Service or its systems; upload material that infringes the rights of others or that you do not have the right to upload; introduce malicious code; or interfere with the operation or security of the Service. We may suspend or terminate access for any breach of these Terms.

11. Intellectual property

The Service and its content (excluding content you submit) are owned by us or our licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your own personal study while your account is active and in good standing. All other rights are reserved.

12. Content you submit

You are responsible for any material you upload or submit to the Service, and you warrant that you have all necessary rights to do so and that it does not infringe any third party’s rights or any law. You grant us a licence to host, store, process and use submitted material for the purpose of operating and improving the Service. You must not upload confidential patient information or personal information about identifiable individuals.

13. Third-party services

The Service relies on third-party providers for functions such as hosting, authentication, payment processing and automated content generation. Your use of the Service may be subject to those providers’ terms. We are not responsible for third-party services, and their availability and performance are outside our control.

14. Disclaimers

To the maximum extent permitted by law, the Service and all content are provided “as is” and “as available”, without warranties of any kind, whether express or implied. Without limiting the operation of section 9, we do not warrant that the Service will be uninterrupted, error-free, secure, or that any content is accurate, complete, current or fit for any particular purpose.

15. Limitation of liability

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, including under the Australian Consumer Law. Where a guarantee under that law applies and our liability for failing to comply with it can lawfully be limited, our liability is limited, at our option, to: (a) re-supplying the relevant services; or (b) paying the cost of having the relevant services re-supplied.

Subject to the paragraph above, and to the maximum extent permitted by law:

  • we are not liable for any indirect, incidental, special or consequential loss, or for any loss of profits, revenue, opportunity, data, goodwill, or any loss arising from examination failure or any examination result; and
  • our total aggregate liability to you arising out of or in connection with the Service and these Terms is limited to the total fees you paid to us for the Service in the twelve (12) months immediately before the event giving rise to the liability (or, if you have paid no fees, AUD $100).

This section applies regardless of the basis of the claim, whether in contract, tort (including negligence), statute or otherwise.

16. Indemnity

To the maximum extent permitted by law, you indemnify us against any loss, damage, cost or expense (including reasonable legal costs) we suffer or incur arising out of or in connection with your breach of these Terms, your misuse of the Service, or your infringement of any law or any rights of a third party. This indemnity is reduced to the extent the relevant loss was caused by our own negligence or wilful misconduct.

17. Suspension and termination

We may suspend or terminate your access to the Service, with or without notice, if you breach these Terms, if required by law, or if we reasonably consider it necessary to protect the Service or other users. You may stop using the Service and close your account at any time. Provisions which by their nature should survive termination — including sections 3, 4, 11, 14, 15 and 16 — survive.

18. Privacy

We collect, use and store personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Our Privacy Policy sets out in full how we collect, use, disclose and protect your personal information, and forms part of these Terms. By using the Service you consent to our handling of your personal information as described in that policy.

19. Changes to these Terms

We may update these Terms from time to time. The current version is always available on this page, with its version number and last-updated date shown above. Material changes will be notified by reasonable means. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

20. Governing law

These Terms are governed by the laws of Queensland, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Queensland, Australia and any courts competent to hear appeals from them.

21. General

If any provision of these Terms is found to be invalid or unenforceable, it is severed and the remaining provisions continue in full force. Our failure to enforce any provision is not a waiver of it. These Terms are the entire agreement between you and us about the Service and supersede any prior arrangements. You may not assign your rights under these Terms without our consent; we may assign ours in connection with a sale or reorganisation of our business.
